The cyclist, Gary Peacock, was charged with disorderly conduct, a misdemeanor crime. The driver, Pierce Kempton, was given a traffic infraction ticket for driving within 3 feet of the cyclist. This was later dropped in court because his dash cam video provided evidence that he was, in fact, NOT driving within 3 feet of the cyclist.
